General Terms and Conditions

SCOPE OF APPLICABILITY
These General Terms and Conditions (GTC) apply to any use of this website. By using the services offered by Tiroler Edle and purchasing goods, customers accept all of the following terms and conditions.

PRICES
All prices quoted in the online store are inclusive of the statutory value added tax of 10%, excluding shipping costs and without any additional services.

CONCLUSION OF CONTRACT
All offers from Tiroler Edle are non-binding. By clicking on the order button, you place a binding order for the goods contained in the shopping cart. Confirmation of receipt of the order by Tiroler Edle takes place together with acceptance of the order immediately after the order process by means of an automated e-mail. For the conclusion of the contract, the customer must also provide proof that full payment has already been made (for payment options, see “Payment”). If the delivery of the ordered products (or parts thereof) is not possible, Tiroler Edle will contact you immediately (by telephone, e-mail) and a possibly corrected order confirmation will be sent to you by e-mail.

PAYMENT
Invoices (including shipping costs) must be paid in advance (free of charge for the payee). The following options are available: Prepayment, SOFORT bank transfer, credit card (Visa, Mastercard) and PayPal.

SHELF LIFE OF THE PRODUCTS
Tiroler Edle chocolates are produced on demand or to order. As we do not add any preservatives, the shelf life from production is a maximum of 5 months for TIROLER EDLE GEFÜLLT and EDEL&GUT, and a maximum of 12 months for PURISSIMA, OBEN OHNE, themed chocolates and “hot chocolate”.

DELIVERY
After receipt of payment, we will ship the goods immediately. Tiroler Edle shall ship the goods at the customer’s expense to the delivery address specified by the customer when placing the order. The risk of loss or damage/deterioration of the goods shall pass to the customer upon delivery of the goods to the customer or a third party designated by the customer. Delivery is made by parcel service, shipping rates (incl. 20% VAT): Austria € 5,50 | Germany € 10,00 | Restl. EU countries: € 25,00 | Switzerland + Liechtenstein: € 30,00 | other countries on request.
Until full payment of the purchase price and all additional charges, the delivered goods remain the sole and unrestricted property of Tiroler Edle.

TRANSPORT DAMAGE
If goods are delivered with obvious transport damage, please complain about such defects immediately to the deliverer and contact us without delay.

WITHDRAWAL POLICY
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods. To exercise the right of withdrawal, you must inform us (Schoko-Laden Haag GmbH, Maisengasse 19, A-6500 Landeck, [email protected]) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, e-mail).
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.
You must return or hand over the goods to us immediately and in any case within fourteen days at the latest from the day on which you inform us of the revocation of this contract. The deadline is met if you send the goods before the period of fourteen days has expired. You shall bear the direct costs of returning the goods. You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties and functionality.

There is no right of withdrawal for (among other exceptions):
– perishable goods or goods whose expiry date is quickly exceeded
– goods that have been manufactured according to customer specifications or are tailored to the personal needs of the customer
– goods that are delivered sealed and are not suitable for return for reasons of health protection or hygiene, provided that their seal has been removed after delivery
– goods that have been inseparably mixed with other goods after delivery due to their nature.
